You will definately have to tell your insurer of the situation. See what they say, but expect it to be bad news. Then go see a solicitor to recover your losses.

Er, lets not all get carried away here. You may still be insured! Basically the terms of your insurance will probably state that it is a requirement for your car to have an MOT. If you brake this tearm it does NOT mean you are uninsured - it will be up to your insurer to decide if they will honour your policy or not - since the accident wasn't your fault I'd say there is a good chance they will honour your policy.
The best thing to do would be to call your insurance company and explain what has happened. My OH is a claims handeler and deals with this type of thing all the time - be nice to the person dealing with your claim and try to appeal to their better nature, they could well approve your claim.0 -

Thank you everybody. Just phoned them and I am still insured, everything stays as it is but I will just get a reduction on my payout because it wasn't mot'd. My advice to everyone is to just deal with things instead of worrying like I did xx0

Either way, they're not going to pay out. And will probably inform the Police too that you had no MOT and were driving uninsured.
You are up !!!! creek. There's no other way to break it to you. The best you can do is to wriggle out of ending up in court and 3-6 points on your licence.
This is a good post to ignore. As can be seen from the outcome, the above post is basically scaremongering. In any case, not having a current test certificate (MOT) is not an endorsable offence. :rolleyes:If you lend someone a tenner and never see them again, it was probably worth it.0
