No. The contract principal has primacy, but you’ll need to get a judge to tell PE - if they pursue this to court.

You are under no obligation to pay this just because you lost at popla.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

do you have the landowner cancellation in writing/email, or was it voice only?
    From the Plain Language Commission:

  • The PPCs always claim they are powerless to stop a charge. What utter rubbish.

    Multiple Choice question:
A: Is there a Supreme Being at Parking Eye HQ who forces them to proceed to enforcement, all the way to issuing court proceedings rather than cancelling it?
B: Do they have the option at any time to agree to drop it?

Answer: B. A is just an excuse and the landowner is a mug if they believe it.

  • It is in an email - the landowner says in their initial mail they will assist in getting the fine cancelled. In follow up emails they say that PE has told them this is not possible.

    Thank you for replies

you need to get a response from the landowner along the lines of "we don't support parking eye taking this matter further, however they are refusing to co operate in canceling this"

This is a little wheeze dreamed up by Parking Eye,
PARKING EYE .... LIE .... YET AGAIN

Ask how the landowner feels about being lied to
Tell the landowner that this shabby parking company
can cancel right up to the last minute.
You may have to involve the landowner in court

Who is the boss here, certainly not parking eye.

Get a copy from the landowner of PE's rubbish reply
which can be shown to the judge

And Parking Eye wonder why they are called cowboys
