CIFAS cat 6 HELP!!!

Hi, first post on here and some advice would be great.

Please don’t judge, we all make mistakes but here goes,
I had banked with Lloyds for 20+ years all going well until recently when I had a letter saying they were closing my account. Reason being I gambled a fair bit and ended up going 3k overdrawn of which I had no planned overdraft this happened due to pending transactions not clearing and me using this money again, effectively putting me overdrawn...
So this was brought to light I realised I’d be in some trouble and have to pay it back of course but I have a good job and was doing so, that is until my bank was closed which was back in September. I set up a Natwest account and a month later was told they were closing it down for a reason they wouldn’t tell me, so now into January I get a Nationwide basic account as I have bad credit was all I could get... I pay in a £2000 cheque on the Monday funnily enough from Lloyds where they have overcharged me over the years and come Friday go to take money out and my cards declined, I call Nationwide to be told they are closing my account and the cheque will take another 3 days to clear and I have to go into branch to withdraw the cash, this is tomorrow so interested to see how that goes! Anyway Nationwide tell me the reason they are closing the account is due to Lloyds putting a Cat 6 mark against me and because my cheque was my first deposit and was quite large they did further checks and they noticed this... So.. I call Lloyds who say they put this on as I went into an overdraft which was not agreed by them and therefore the marker has been placed, I appreciate I messed up but to put a Cat 6 Mark and basically call me a fraudster seems a bit much... I am now unable to get any kind of bank account, I have large amount in wages due in 2 weeks aswell as bills etc to pay, I’m at a loss on what to do... any help or advice would be welcome and again pls don’t judge.     Category 6 – First Party Fraud

    Criminal fraud by the account holder. This encompasses false loss or theft reports, significant misuse of accounts, uncleared effects frauds, direct debit fraud etc.
    You would not get cat 6 markers for simply going overdraft, but if you intentionally spend and re-spend money before it clears up, you may have just committed fraud (though it would have to be more than once for them to care enough). Is there more you are not telling us to this? If we don't know, we can't help, it's pretty simple like that. Your username is clearly anonymous, so there is little downside to being honest, and then we CAN help you, but you must not withhold anything.

    So your first step is to submit a SAR to CIFAS to see what is really going on there. This will take time just to get back, and likely months to resolve this whole mess, so for now you may be best to use some friends bank account for the money. Although, I have to ask, why are you having large checks deposited? Most people are paid by bank transfers, not checks, this is a very odd place to be in.

    There isn’t really more to say and it is as I have said above, I think the only thing being is I agreed to pay off the £3000 with a monthly arrangement, I broke that agreement and missed a couple of months due to not being able to set up an account and from just putting it aside and forgetting. I think my question is whether it is worth me fighting this because I can’t go by without a bank account it’s a life essential really. I don’t see how this is Fraud yes it’s mismanaged finances and bad on my part but to be classed as a fraudster now for 6 years seems a bit harsh...
    I will be going the SAR route with CIFAS to see what further info I can get in the meantime..

    Mismanagement at a certain point and of a certain type can constitute fraud, it may be worth challenging it if you can afford the process (almost certainly will need legal help with that) but for that wait for the SAR.

    Why are you being paid in cheques? This is quite suspicious on its own, and why the banks did additional checks.
