Can I become director of Management Company

Hi there

My flat is one of 48 flats in a block that has a Management Company set up to manage it. This company has two directors and between them they appointed, in 2009, a managing agent. The managing agent's two directors are the same people as the Management Company. They are simply property investors and are no leaseholders themselves.

Is it possible to become a director of the company along with 2 other leaseholders to have some power as to what managing agent we can appoint?

The Management company is company no: 04234550
Managing Agent is: 01945750

There are 47 shareholders of Motley Heights Management, presumably one per Lease. It is the shareholders who elect the Directors so it will depend what a majority think of the idea.

Speak to other leaseholders in the block (assuming anselld is right in that the leaseholders own the management company).

Then attend the next AGM and get yourself elected as a Director. You'll need support, so treat it like a government election ie knock on doors and pursuade other people to vote for you.

Often, people are very apathetic and very few attend the AGM. So the same 2 people (who always turn up with a couple of friends/supporters) get re-elected without contest year after year.
  • Hi there.

Unfortunately in 2009 the Company passed a resolution to dispense with holding AGMs.

Not my area at all, but is that legal?

How do officers get re-elected? Or is it a job for life?

    Some information here

I know where my friend lives they have stopped having AGMs - because no-one attends.

I think the OP needs to do some doorknocking as suggested earlier in the thread. In my experience there can be a lot of apathy on communal estates/in flats - especially if there are a high number of tenants.

I would have a readd of the Act then

and I'd also contact leaseadvice, a government funded advice service.
