    I know this is an old thread, but the subject is still current. There is a way around it if one has access to options and the wanted ETF is optionable.

    The regulation forbid buying it but not holding it.

    The exercise of an ITM American option will put the etf shares in the portfolio.

    It is a pain.
    I wanted to buy the ITA Aerospace and Defence ETF, but couldn't.
  • This really is a pain for QQQ - one of the biggest ETFs in the world. There is EQQQ now, which is a partial solution, but you can't buy/sell live in the evenings since the London market is closed. Ridiculous that you can now buy things such as AAP3 just by answering a few questions (which you can lie about if you want), but not QQQ which is very much safer.
