Charged fees for something ebay perceives as being sold off ebay

    It doesn't have to be according to their terms, it says 'When we believe a transaction has been completed outside of eBay'

    Some people have even had a warning for discussing addresses and collection 'after' the sale on ebay has occurred!

    Yes, I am one of those people.

    I suspect ebay are using scripts to scan e-mails - ie if they find a phone number, they run a check to see if the number found is the same number as associated with your account, if so, issue warning or restriction.

    I suspect there are probably privacy implications too with this sort of bulk scanning of emails, certainly they will not be looked at by actual people.

    Actually I hadn't seen that - must stop reading on a phone!

    Op if your sale on eBay didn't occur, did you open an unpaid item case or correctly cancel the sale?

    Sellers have always been able to accept other payment methods - Ebay fees are applicable regardless of this, and are separate to the Paypal's fee.

    There is nothing wrong at all with requesting an alternative payment method - and the Ebay rule change isn't about alternative payment methods.

    It's possible to have an Ebay transaction not paid for with Paypal while remaining inside Ebay - I estimate 30% of my transactions are non Paypal.

    I don't think anyone disagrees that sellers can offer other payment methods as long as paypal is shown, however, the question here is that this does not appear to be an ebay sale- OP clearly states it was sold on Gumtree.

    So the question is was it offered on ebay and actually sold on Gumtree in which case this does appear to be a clear breach of ebay terms and conditions. (yes we all know ebay own Gumtree but for sale purposes they are different entities). Obviously if seller didn't list on ebay and ONLY offered and accepted on Gumtree then it doesn't make sense- as ebay cannot claim fees on an item that never ever appeared on their listings- unless of course all the communication took place through ebay messages.

    With the latter example I often used to list one item in a set on ebay- and if people asked whether I had the rest of the set could discreetely guide them towards a different site to sell, it was always risky but nowadays that is a clear and chargeable breach.

    Under non of those scenarios is Ebay entitled to a fee, it seems to me by suspending the buyer, Ebay sabotaged the sale effectively by restricting buyer and seller communication.

    I can see no circumstance where Ebay are entitled to a fee - 'belief' isn't enough, put simply if Ebay try to enforce this fee, they will lose.

    Yes, I think we all read it like that. What we need from the OP is how she/he closed the first sale, the one on eBay. Did she NPB or cancel. Perhaps she did nothing and got the FVF as she should, but also got the warning.

    In the OP it sounds like the buyer was restricted, not suspended. That wouldn't cancel the sale.
    I then received a phone call from ebay saying that they have blocked the buyers account for 7 days because she tried to send her telephone number to me

    Thanks for the replies, the piano was listed on both ebay and gumtre from the outset. When ebay restricted the buyers account, I then found a buyer on gumtree. I then removed the listing (item not available anymore option)

    In my original message to the buyer(via ebay), my reference to ebay and paypal fees was incorrect. I should have referred to paypal fees.

    After the listing had ended, my ebay was restricted. i was on holiday for 3 weeks so ignored it. Then came the invoice last week.
