Forced tenancy agreement ?

I am currently on a 12 month tenancy agreement which will expire Jul 2008. I am planning a trip round the world starting later in 2008. At the end of my current tenancy, can the landlord/agent force 6/12 month tenancy agreement? If so, can I refuse this and effectively force a month to month tenancy ?

    A reasonable landlord shouldn't have any problem with this if you are a good tenant. I would be inclined to advise them of your intentions fairly soon and ask that the tenancy be allowed to roll on month by month until the date you want to leave. You will still need to give them formal notice. The LL should be grateful to know so far in advance when they will need to find a new tenant.

    I'd suggest you tell the LL that you intend to leave during 2008 and will give them 3 months notice nearer the time, and that you will allow viewings of up to 4 per week (?) from 6 weeks to the end of the tenancy, increasing to 8 (?) per week at 2 weeks to go.

    That would be a decent way to proceed, assuming they've been an ok LL

    A landlord cannot enforce a new lease at the end of your current agreement.
    As long as you are paying rent, then the lanlord should be happy.

    You would then be in a periodic tenancy meaning you only have to give one months notice while the landlord has to give you 2 months notice.

    It may be possible that the landlord would like to get some security that their property is rented and may be looking to advertise for new tenants when you are in your periodic tenancy.

    I take it you want to go month, by month until you are ready to start your trip, whereby you would terminate your lease.

    The other advise you have on here is good advice to adhere to.

    we were in a similar situation as we relocated around 11 months ago and have been looking for a house ever since. when we moved we had a 12 month lease with a 6 month break clause which worked on 2 months notice.

    After 9 months, the letting agent automatically sent us a renewal form stating whether we wanted to renew for 6 or 12 months and informing us that they would charge £75 or so for the pleasure of priniting a document and posting it...

    I simply wrote back stating our circumstances and that whilst we were happy to continue in the property on a statutory periodic tenancy basis we did not want to sign up for another fixed period.

    The landlord was happy as we have been good tenants and hes guaranteed his rent for at least a couple of months without having to pay up for fees and loss of rent in the interim period.

    I am very happy because I have the flexibility of a months notice, no fixed term, no bloomin' letting agent fees to pay etc etc

    Even more happy that we have found a house which is going through at the moment so probably only ever needed a month extra rental on top of the 12 months but had no way of knowing at the time.

    So anyway, the point is don't let the letting agent push you for a fixed term, its not required, if you and the landlord are happy then theres no reason you can't move to a periodic tenancy.
