Item to be removed from deeds eve before exchange

We were due to exchange last week and have been promised since then that we will exchange every day since. Still haven't. Anyway the problem was that on the eve of exchange last Thursday the sellers solicitor found something marital on the deeds that needed to be removed and arranged to complete on Monday when cleared. What was it likely to have been and could it still be holding up the exchange. The deeds are only in one persons name.

Any help or ideas appreciated.

    It will probably be that the seller has divorced or separated and the right of the ex to live in the home was granted under a matrimonial homes act. Basically it is like a charge on the property and the sale won't proceed until the ex signs away their rights.

    Presumably the seller was aware of this and has either reached a financial settlement with the ex or the ex has agreed to the sale proceeding and the charge moving to a new property. In which case, it is just a matter of getting the ex's signature on a piece of paper.

    If the seller is trying to sell without the ex knowing, then there could be a serious delay.

  • Interesting. If it is that and a delay then the sale won't happen. The sellers solicitor said that she would phone our solicitor on Monday to exchange after sorting this and so far she hasn't and when our solicitor called her she had gone home (or was avoiding him). Our solicitor doesn't know any more at the moment but they want to complete on Friday as he has broken the chain to allow us to move, as the person he was buying from pulled out of her sale again. Its been nearly 6 months since we started with the house, and hassle all the way so nothing would surprise me now.

    Hopefully it will just be an oversight. He must have known the charge was there.

  • I give up with it all at the moment After 6 months of waiting and now its taken nearly a week to exchange (still haven't) and he wanted to complete this Thursday, which has now slipped to Friday! His solicitor won't return our solicitors calls its just too much now really, can't keep living on the maybe tomorrow hoped to move the kids over half term, and haven't even told the school they will be leaving yet as can't.

    Don't know if its the charge causing the problem or not, should the solicitor have picked it up earlier?
