Faulty replacement

Hi, I bought my husband a pair of wellie boots from an online store in Sept 2016 at a cost of approx £70 - these developed a split after 9-10 months. I got in touch with the shop & they replaced the boots in July 2017. Unfortunately, these replacement boots have now developed a fault in the sole & are letting the water in. I've contacted the shop, who have contacted the manufacturer who has said “If goods are repaired or replaced under warranty, the original warranty period is not extended. These goods are covered by a one year warranty against defects in material and workmanship. The original pair were purchased in September 2016. The replacement pair were reported with an issue at the end of December which is 15 months after the original purchase.”

The shop have said they are therefore unable to do anything about this faulty pair.

This seems like a reasonable explanation but the replacement pair only lasted 5 months, which is not really acceptable. Any advice on what I can do?

    The only option to you is to exercise your statutory rights with the retailer and claim a remedy (ie, replacement, repair or partial refund) under the Consumer Rights Act (CRA). However, the onus is on you to prove the fault is down to a manufacturing issue. Really depends on how you value your time for a £70 pair of wellies and how decent the retailer is.

    Next time, forget about getting fancy , fashion based wellies, you could save yourself some money and get something that would last. My £10 dunlops are still going strong after many years of abuse ;)

    They can ask you to prove that the boots are faulty, which will likely be difficult as this is usually by you commissioning an independent report. Where you would find a "welly expert" to write a report i haven't a clue!
