Money taken from card 14 months after transaction

I have a prepaid Revolut card which I use for transferring funds from my bank account to and using when I am travelling.

In September 2016 I used it to hire a car from Europcar in Italy but the payment of £197 only came off the card in November of 2017. As this is a prepaid card and I had used it overseas several times after the Europcar transaction I had not accounted for the transaction not coming out of my account. So my card is now £197 overdrawn because in November 2017 the card did not have any funds on it. I had not accounted for the fact that a payment would take 14 months to be taken from the account.

Is it legal for a company to not take a payment off a card this length in time after the transaction?

Any advice would be greatly appreciated.

    In a word: yes.

    It's legal. Did you directly hire in Italy (in which case Italian law will apply, or prebook via the UK website, in which case it is English law).

    Whether it is within the terms of the card processor (Visa or MasterCard) is something that I'm not 100% about.

    You're saying you spent the money, that should have been used to pay the cost of hire?

    You are overdrawn because you did not leave the money in your account to cover it. Surely you noticed you had an extra £197 to spend.....or did you think you had got away with it and now crying foul.
  • Sorry OP if you expected sympathy or perhaps you thought you got a freebie - but if you did hire the car and they have not claimed the money then why do you think they cannot debit your card?
