But I always could ask the credit card company and cancel each illegal transaction they made.

You have given your authority so in what way can they be illegal?

If you have a dispute with the retailer then the card company will not step in as you won't have any proof that it's illegal (and the retailer will have your authority to say you DID agree).

The card company will halp you in blatant cases of fraud but in a dispute where the legalities have not been decided and there is an authority agreed by you then they will NOT side with you.

Guys it made me now a bit worried.

I just have moved to Be Broadband and have given my Credit Card as a payment method because of 1% cashback. It has told me that the card will be every month charged at the same time for this amount. Is that what you meant with having no control?
    Yes, exactly.

It's not illegal. By asking them to pay by credit card, you have given them permission to take a recurring payment each month. They are not taking payment without your consent; you have consented to the agreement. So you cannot just chargeback if you don't want them to take a payment one month for whatever reason - because you've given them permission to take that payment. Hope that helps!

Damn. I am panicking now. All i did was to click a box that I had to in order to set the order. I didn't even sign for it.

But maybe one idea...if I know I am going to quit, I could switch from Credit Card to Debit 1 month before. So i have some time to see if they listen to me.
  • Wow!
    Thanks for the quick responses.:T

I think I'll just stick with the DD method I've got now.
It would be too much hassle to keep changing the CCAs as I'm a bit of a wanderer, I'm always changing my electricity and gas suppliers.
    Many thanks all:beer:

  • As I have suggested in previous threads, if you do wish to cancel a CCA payment, send a letter by recorded delivery to the company in question stating that you are no longer authorising them to take payments from the card. Send a copy of the letter to your credit card company, also by recorded delivery. You then have a valid reason to dispute any further transactions, with some proof!

Not sure exactly how it works in this case.
They can certainly charge to closed cards so I expect the answer is YES, but whether it goes on the old or new card I don't know (perhaps it gets automatically transferred to the new card).

This may not work where you are legally obliged to stick to a contract for a minimum period i.e. your letter may not be legal.
Credit card companies will not simply take your side at face value (or so I've heard).

No definite answer to this. If it is a genuine CPA as discussed then yes it would, and same goes if your card replaced due to loss/theft - any CPA authorised on the account with a valid card is good until cancelled, regardless of what happens with account (even if it is closed)

Some merchants wont set up a CPA though and will retain your credit card details, putting it through as new transaction each month - this would fail when original card has expired

My broadband service gets charged monthly to my credit card. When my credit card expired, they asked me to update the expiry date or change the card to a current one. If I hadn't updated the expiry date, could they still charge my card ?

Anybody put this to the test ?

Right; so that's what is happening with the broadband charge.
