Argos Refund Policy

I bought a Lenovo Tab 3 7" tablet from Argos for son two days ago. I assumed that as it ran Android 5 I would be able to set up a restricted user like on other similar Android tablets we have. It was until I had booted the tablet up that I discovered that there was no option to add additional users. Therefore, I decided to return it for a replacement tablet.

As the tablet was bought over the internet with collection from the local Argos store, I had assumed that distance selling rules would apply and I could return within 14 days. However, the manager at first tried to refuse the refund on the basis it had been used. I stood my ground and stated it was not clear from the description on Argos' website that the feature normally found on Android tablets was not available and I only discovered the problem on trying the unit which was within my rights.

Fortunately, the manager relented and I was granted a refund.

For my future knowledge who was right the manager or me?

At what stage did you actually pay for the tablet?
  • Well, the distance selling rights effectively give you the opportunity to inspect the goods like you would in a shop... So it sort of depends and hard to say definitively in your case. If you set up a user profile and only discovered the issue after then* I'd say that you may not have been entitled to a full refund. Usually, though, the more you protest the less the staff will want a headache and may relent.

*You are hinting at the product being not as described... If the advert stated that it allowed you to create the user profiles then the item wasn't as described. If it wasn't specifically mentioned then you have a very weak argument. Basically, you can't just assume that it will have a feature just because of past experiences (any way, the liability may be with a third party)

I paid online at the same time as I ordered.

Just double checked the description on the Argos website and it states includes a safe mode for kids. Even if that statement wasn't there I would argue that the tablet was not fit for purpose as how could you give a tablet to a child if you can't restrict access to the internet and apps.
