I already saw on a skim read, that they tried to mislead you that they haven't discriminated because they 'didn't know' about an individual's disability....as predicted! A Judge would need to be told that the short except from the EA, that PE have quoted, is (misleadingly) the bit relating ONLY to direct discrimination.

But you weren't saying that! You were not accusing them of direct discrimination - but funnily enough, you can now that they know!

You were saying they'd failed in their duty to provide an anticipatory adjustment of time for the general disabled population at large (faceless people with medical conditions not known, but certainly all among us!), like in the Norwich Council case pushed by Helen Dolphin of DMUK.

That's INDIRECT discrimination, different illegal conduct! No need for PE to 'know about' individuals, and there's no lawful excuse to blame the consumer or their carer, for not saying what they didn't know they had to say and for not claiming a right to extra time they didn't know they could.

Thanks, they read what was written to them and put there own spin on it. I knew their response was not write but was unsure how to tackle it.
