PPI - HSBC say they don't have my credit agreement.

Hi al, I've searched for a thread about this but was unable to find one so am posting to ask for some advice!

I used the letter template from MSE to write to HSBC about PPI on both a personal loan and a credit card. The loan PPI inquiry appears to be being dealt with a I was sent a letter explaining the process etc. However, I received a letter about the credit card inquiry in which HBSC have said that they do not have the details of the credit agreement, so I have no details with which to fill in the PPI claim form and, i'm assuming, they won't have a note of any PPI applied to it as well.

The card was taken out around the same time as the loan (early 2000's) and is still active. I am very sure I had unnecessary PPI on this just as I thought I had with the loan (and my inquiry about it proved that I did) but I'm unclear what I can do now. Should I just put a claim through without knowing the PPI policy details? and why don't they have my credit agreement filed?

Grateful for any tips! Thanks in advance.

  • Put whatever you remember.

They don't have your credit agreement as they are obliged to delete it in line with the DPA.
  • Thanks, I will. Will that mean they also won't have my PPI information either?
  • Possibly. .

If you still have the card, then you would see if there was PPI being paid as it would appear on the statements. So, just enclose a copy of a statement showing the PPI being paid.

Unfortunately, you've fallen into the trap of requesting the Credit Agreement which the MSE article only suggests you request because it is cheaper than a Subject Access Request SAR letter. You don't actually need the Credit Agreement to make a PPI complaint, all you need is evidence that you paid PPI and valid complaint reasons. Instead of requesting documentation, you should have just asked the Bank directly if you had PPI on the card. As you still have the card, the Bank should still have records.

I doubt any recent statements will have itemised PPI, of course.
  • Thanks for the responses. I used the credit card letter template from here and paid £1, I'm surprised to learn that was not the way to do it.

There's definitely no PPI itemised on my current statements, but as you say this is unsuprisiing.

I will approach HSBC and just ask if PPI was ever applied to the credit card.

It was a waste of a £1. There is no requirement for you to do this. Not only that, most credit card PPI was actually added after application by most card providers (typically over the phone).

Every statement you get with it not being on there is a month you have not paid PPI.

PPI is only ever paid if you borrow on the card outside the interest free period. i.e. if you pay the balance off each month, no PPI is charged.

  • I've had the card for over ten years, so could only go back through a few months of statements. Thanks.
