    If you can show that it has previously been defaulted on your file (you don't need the default notices that were sent by the company to prove this), then it should not re-appear and you can successfully get it removed. I had this issue with a default (one I had satisfied) being re-reported for two months after it should've dropped off my file. I have had the company remove it now as they admitted that it should not be there. That is different to the OP who doesn't think it was on the file previously.

    I think you have to go through a formal complaints procedure first, and only if they don't deal with your complaint to your satisfaction within 8 weeks can you refer it to the ICO or FOS?
  • Good news!

    The company has agreed that the account should be removed from my credit file, and asked Equifax to remove it.
