Reinstating a bricked up side facing 1st floor window

I understand side facing windows on the first floor are generally allowed as a permitted development if they are "obscure-glazed and either non opening or more than 1.7 metres above the floor level" -

as stated at planningportal.co.uk/info/200130/common_projects/14/doors_and_windows

I want to reinstate 2 sash windows into the original sites used in the construction of the house (and ones that our facing neighbour still has in place). These could be obscure-glazed but wouldn't satisfy the 1.7 metres above floor level criteria.

Is this then a case for a planning permission application to deal with or should we be allowed to put them in on the basis that it is a restoration back to the original construction?

Naturally, I'm hoping the latter but haven't found any policy documentation to back up your rights that supersede current regs if restoring a previous original feature.

Any pointers appreciated.

    How old is the house, and do you have any idea when the windows were blocked up?

    As far as I know, the fact the windows were there once upon a time will not be of relevance to the planning situation.

    Anyway, if they were blocked up before 1948 they might as well never have existed as the "original" condition of the house is taken to be the condition on 1st July 1948!

    It doesn’t have to be obscure AND non opening AND over 1.7m.

    They need to be obscure (and non opening) OR over 1.7m (they can open)

    Essentially, no one needs to be able to see clearly out of them onto neighbouring property. If you want sashes, you can’t open them.

    It’s not just PD rights, the same criteria applies to windows with planning permission too. Re-instating a previous feature has no bearing on the outcome.
    Everything that is supposed to be in heaven is already here on earth.
