No charge printed on PCN is it valid.

Sorry I am new to this as got first experience with this type of business yesterday and have read many threads. PCN was from UKPC.

Am I right to believe that this PCN is invalid and can't be in acted on as missing vital information as the bit which states the charge is blank and also the bit states discount if paid in 14 days.

The attendant was in such a rush to do it as my back was turned binning trash in while waiting, car not lock and not on the yellow line but ticket says parked! There are signs saying no parking on road and details of charges ect. This is a free car par for customers but I was waiting on road to one of the outlets early in morning waiting for it to open.

Ticket says time seen and time ticket issued as the same time 09:12???? Less than a minute!!!

I hope I am lucky, because he rushed, ticket did not fully print.

Reading traffic management act. It states info on ticket needed, but does this apply to all tickets or Penalty Notice Charge fro policemen or Councils.

I am appealing.

As long as he correctly recorded your VRM, then this will be pursued. There are no rules that any PPC will follow which interfere with them grabbing your money. You’re in no different a position to anyone else who comes here for advice. You need to follow the advice in the NEWBIES FAQ sticky, post #1 which guides you through the initial processes.

Seriously, hold off on sending that appeal (until day 26, as explained in the sticky). The appeal is already written for you in the sticky. Here’s some standard advice I give about making your initial appeal.

Make sure the initial appeal is sent to the PPC by their deadline date, normally 28 days from the date on the NtK for a BPA Operator, (21 days for an IPC Operator, but no POPLA for IPC Operators), otherwise you can kiss goodbye to POPLA.

Also, equally important in the submission of the initial appeal, you follow precisely the method by which they require you to send the appeal. Preferably do it via their website appeal portal (if that’s the method they require). But if it says by email, don’t send it by post (or vice versa). If it asks for the keeper’s name and full postal address - give it, don’t provide an email address instead, or try to be clever with a M Mouse, Orlando, Florida!

Be careful of any drop down box if the appeal is via a website appeal portal, that defaults to ‘I am/was the driver’ - make sure that isn’t showing when you press the ‘Send’ button.

Having read all the legal stuff, they can only chase you for money owd which has to be stated in the Notice correctly as stated in the Protection of Freedom act ( recovery of unpaid parking charges ). Section 7 & 8 respectively. The space was blank on the PCN, both parts.

If I had chucked this away as most poeple do, then I would have no evidence of their mistake.,
They can't chase me as this is their invoice to me.

I may have got an early Christmas present as attendant was in such a rush that he must of cocked it up.

There is nothing to stop them ' chasing ' you if they have a VRM. This is an unregulated murky business....
Ultimately and legally, as the RK, they will have not followed the POFA and could not hold you liable.

But you seem to have identified the driver in your posts, and I hope your username is a sudonem....

Amend your posts please.

I will run the gauntlet like everyone else and see........

The firm was UKPC.

I am quite shocked at what I am reading on this subject and wonder how this is allowed in this country, tax on unsuspecting people to make a few rich.

They make millions these companies and their directors, if they follow their example of the company's they own will most likely not pay their share of tax.

Sometimes I don't like my country.

POFA is now irrelevant as you have given the scammers the driver's identity on a plate. This now makes it harder to beat, but not impossible.
When you get the inevitable rejection you will need to go down the PoPLA route using as many of the appeal template points that are relevant from Post 3 of the NEWBIES.

Get some pictures of signage and compare them with the BPA CoP. Use the long signage template point as well as Not the Landowner, No standing to issue charges in their own name.
Also use the lack of information from the NTD and see where it fails to meet the requirements of the BPA CoP.

Make sure you also complain to your MP about this unregulated ripoff scam and ask him/her to confirm that they will be supporting the private members bill on this subject next year.
