Subject Access Request no help. What now?

Hi,

I had a loan through my bank account (at time Alliance & Leicester, now Santander) in 2005, for 4years.
Have tried claiming PPI but couldn’t remember loan agreement Ref number and I have no records from that time.
I contacted Santander who suggested doing a Subject Access Request for any details before 2010 as they do not have current records prior to 7 years. I did a SAR for my records from 2001, and Santander haven’t been able to provide me with anything before 2010.

Where do I go from here?

    If you have been a customer of Alliance & Leicester, now Santander since 2005, I doubt very much they would have deleted your records.

    They might have disposed of paper documents older than six years but not transaction history which is stored in microfiche and deemed a relevant filing system for the purposes of the Data Protection Act 1998.

    Write back to the SAR department asking for copies of bank statements or transaction lists since the account was opened. The loan account number and direct debits should be listed. If they do not comply contact the ICO for advice.

    If you are still a customer of Santander, then you would expect some data to be retained. Transaction history may well be deleted by now but enough to identify if you had a loan with or without PPI should be there. However, if you are no longer a customer of Santander (on the old A&L side) then records probably have been removed. Especailly if you ceased to be a customer before Santander took on A&L customers.
