Does this mean we have won???

We received a General Form of Judgement or Order today from Wellingborough County Court stating:

'Before a PROPER OFFICER sitting at Wellingborough County Court...

Upon the defendant failing to comply with paragraph 5 of the order dated 6th June 2007

IT IS ORDERED THAT

the defence is struck out in accordance with paragraph 6 of the above order.'



In paragraph 5 of the order sent to us dated 6th June 2007, it states that 'the defendant shall by 8th September 2007, file and serve a schedule in response to the claimants schedule stating in respect of each item claimed

a) persuant to what contractual provision such charge was made

b) if such charge is alleged to be lawful, the basis on which it so alleged...etc'



In paragraph 6 it says that if they fail to comply with this the defence will be struck out and the claimant shall be entitled to enter judgement without further order.




Does this mean we have won??? If so how do we 'enter judgement'??

It doesn't to me sound as if this is a standard letter sent out by the court to put everything on hold whilst the test case goes through the high court. Is this right?

  • you have won...u need to enter judgement now which is form N225 if you need more help am here....lucky you by the way....my defence was struck out on the 20th sept yet blinkin judge granted a stay on 2nd October...am trying to get that decision overturned without having to pay a fee.

    Thank you, I have just filled N225 in. Do we send this to Wellingborough County Court. Do we have to send anything to Barclays also?

  • yes to the court that issued the judgement make sure you have ticked part A and written underneath the defendant has not filed an admission or defence to my claim (the Defence has been struck out) and that you ticked D (immediately)..you dont have to send anything to barclays.

  • thankyou....:beer: but before you send off the judgement form...phone the court first and see if it is required, there is no fee but it might be wise to ask for the Courts guidance
