Email and physical mail responses to all six LBCCCs have been sent, and I've drafted a section 10 DPA notice using the template provided in the thread from this forum - any glaring problems with it?Data Protection Act 1998 – Section 10 Data Subject Notice
I am the registered keeper of the vehicle with registration number #### ### and I have received six PCNs from your company, followed by six Letters Before County Court Claim (reference numbers: ###, ###, ###, ###, ###, and ###).
These PCNs and Letters allege that I breached the parking terms and conditions at XXXX Retail Park on six occasions during October 2017. No such breaches occurred because at the time, I was employed at the BigRetailer store at XXXX Retail Park, and as an employee of one of the retail park’s stores, was permitted to use its car park without charge in the course of my work. You were notified of this on the 20th of September 2017, three weeks before the first supposed breach, and acknowledged receipt of this notification on the same day. Moreover, since sending the PCNs mentioned above, you have been repeatedly notified of this and asked to withdraw your demands by both myself and the senior manager of the XXXX Retail Park BigRetailer store.
As a result, there is no legally-enforceable parking charge and no justification for you to pursue me. You have, therefore, obtained my personal information without reasonable cause. This is a clear breach of data protection principles 1 and 2 of the Data Protection Act 1998 (DPA). Your unreasonable and unlawful demand for payment is causing me significant distress and anxiety.
I demand that you immediately cease and desist from processing my personal data, except to inform me that you have complied with this demand. Any further processing of my personal data, including demands for payment or passing my personal data to any third party, will be considered harassment and a flagrant disregard of the DPA, which will be reported to DVLA and to your ATA, and may result in legal action against you for compensation or damages, including Exemplary or Punitive damages.
The DPA requires you to respond to this notice within 21 days to confirm that you have or will comply with my demands, or to explain why you have not or will not comply.0 -

My wife just checked the status of her six tickets on PE's website, and they all show up as having "no amount outstanding", so it looks like PE have cancelled them all. We've not yet had an email or letter to that effect from PE, so we're not going to be completely relaxed about things, but it's definitely a promising sign. Many thanks to everyone who's helped us out with advice here, especially Coupon-mad!0
