Illegal booking fees

I know that booking fees on credit cards are suppose to be illegal from January next year, but I'm wondering if Hull City Council have found a way around it.
Hull New Theatre has recently reopened following refurbishment and with it a brand new website, covering both the theatre and the City Hall.
Since this, the council have now started charging a £1.50 booking fee per ticket, regardless of how you get your ticket (post, mail or pick up from the venue), which is obviously paid for by card been an online order. In addition, if you actually go to the ticket office to purchase your tickets in person, you are still charged a booking fee of £1.50 per ticket REGARDLESS of whether you pay by card or cash.
As the point of the change in the law, due to EU Regs, was to ensure that card payers were not 'punished' by hidden costs such as booking fees, as Hull City Council are now charging everyone a £1.50 booking fee per ticket, however and wherever you purchase your tickets, thus ensuring that all pay the same, are they within the law or will this have to change in January?

Booking fees are not/ will not be unlawful. They are charged to cover admin costs, preparing tickets for posting/ collection, staffing the boxing office and so on.
If there was any doubt they could simply increase the cost of each ticket by £1.50.0 -

Hi all,
I’ve just been charged an ‘online booking fee’ for booking (admittedly reduced cost) tickets for our child’s day out. Being as we won’t get charged this for paying at the door, I take it this is still perfectly legal?0
