UKCPS Parking Fine - Advice needed

Hi all, Firstly I apologise if this has already been answered in a previous thread but I read a few & couldn't fine one with the same details.
My husband recently parked at Lidl in Spalding, when we returned from shopping he had sparking notice on his windscreen advising he was being fined £60 for parking outside a marked bay. (We were outside a marked bay but we parked in between other vehicles as it was so busy & the car park was full). We wrote to them appealing, advising there were no signs to say this & other cars had also done so. We got a letter back advising our appeal had been rejected as there are signs advising of this.
I have looked online & from what I can see everyone’s appeals get rejected & all the advice shows they can only charge if they are the owner of the land & if they were at a financial loss but as this is a free car park they is no loss.

My concern is if there is a sign that states about parking outside marked bays (we are unable to check as it is not local to us) & they can take this matter further? We have also contacted Lidl to ask if they would get the ticket cancelled & they we're interested.
On a further note the vehicle was owned by a company which has since gone into liquidation & I have since purchased the vehicle (yes wishing we had not appealed now!)
I would post photos of ticket & letter but have no idea how to. Could someone please advise what we should do from here?

sorry there were paragraphs, I have added more at your request

host the pics on tinypic and add a dead URL on here by changing http to hxxp in your reply, we will fix the link in our replies

I have no idea what you mean??

and I hope you have read the NEWBIES FAQ sticky thread about 3 threads down from the top of this forum ?

yes as stated I read a few threads but still don't know what I should do/where I stand due to the actions we have already taken & implications of the vehicle changing owners.

I'm sorry but I don't understand why you replied, I am after advice & help not criticism!

firstly, there is nothing wrong in my post above and I told you exactly what you needed to do in order to get constructive advice about your situation

the fact that you dont understand it is your problem , not mine

and criticism is a part of the advice , so you need to develop a thicker skin and accept criticism as a part of the process in this topic

I am partially dyslexic and cannot read a wall of text that has no white space in between the paragraphs, so if you study my earlier post , your later post and this post I am typing you will see white space created by use of the carriage return key which is the basics of creating PROPER paragraphs

when you also think that people are viewing this forum on a variety of devices including tablets and mobile phones as well as laptops and desktops then its important to divide paragraphs into readable chunks with a white space border and white space separation

I am one of many regulars on here that tell people to edit their posts into readable paragraphs, it just so happens that I was the first one to try and help you and posted a reply. Its not just you that gets told, its everybody that fails to add white space between paragraphs

I take no pleasure in explaining this to an adult who has over a hundred posts on here and been a member here for twice as long as myself

I also explained how you can host the pics and make them available to the members on here , in fairly simple terms, the fact you dont understand the "geek speak" is again YOUR PROBLEM , not mine

coupon-mad thanked me for my reply earlier and clearly she thought I had done enough to get a better response from you so that you could get the advice you seek, something that you still have not done properly or at all because you would rather "shoot the messenger"

as a regular on here with thousands of thanked posts (including post #2 above) I replied with what I considered the minimum requirements for YOU to do as tasks in order that YOU get the advice you seek

the editing of post #1 is only half done and needs more judicious use of the carriage return key to break it up into 3 or 4 separated paragraphs with white space separation

then you need to do as I said in regards to showing us the pics you wanted us to see (its not our job to teach you to use your pc and the internet , merely to point out what you need to do in order to achieve your aims)

    so I repeat

    1) edit post #1 into easily readable paragraphs if you want advice on the content

    and

    2) host the pics on tinypic and add a dead URL on here by changing http to hxxp in your reply, we will fix the link in our replies

    and

    3) I hope you have read the NEWBIES FAQ sticky thread about 3 threads down from the top of this forum ?

regarding 3), at no time did I ask if you had read random threads, I asked you specifically if you had specifically read the only thread you need to read ? ie:- the NEWBIES FAQ sticky thread near the top of this forum

we dont care if you have read several other threads, just the one that matters , especially because that one thread covers EVERY SCENARIO , so dont think that yours is any different, its NOT !

a simple YES or NO would have sufficed, not more whingeing

hope that long winded explanation (and criticism) explains it even though it appears patronising

if a disabled person suffering from mild dyslexia like me can try to help, dont "shoot the messenger" and accept constructive criticism for exactly what it is, a means to an end !!

Post one/paragraph one of the Sticky covers your details exactly - don't make the mistake of assuming you are anything different. That inevitably leads to failure.

The rest of the thread lays out your different options for challenging it.

You did get help, loads of posters are advised to please put in more paragraphs, it's not personal!

And everyone's case is covered by the NEWBIES sticky thread, nothing is different. Last week we saw a case from UKCPS cancelled when they saw the template appeal for IPC members. If not then ignore them unless they try a claim (we see posters win 99% of the time on this forum when fully-coached throughout).

  • Hi Coupon-mad, thanks for the response.

What i'm trying to figure out is - do I just need to send one of the template letters?
I am concerned as the ticket was sent for parking outside the lines & also as we have admitted who the driver is & there has also since been a change of owners.

I'm not trying to be defensive or off with anyone but we are currently going through insolvency & have this stressing me out, I just want to get it right.

so edit post #1 so others like myself can read it for starters (still not done)

    background

UKCPS are IPC members so the same advice as for anyone else, you send the black text appeal to them (which will be refused) and then you IGNORE them for 6 years unless they issue an official LBC or an MCOL from Northampton CCBC (small claims business centre)

anything else in your post wont be relevant UNLESS it is to go before a judge as a defence and/or as evidence

as its private land, any issues about signage and bay markings etc will be decided in legal terms by a judge

nothing you can say will change my advice above, it applies for EVERY ipc member including UKCPS

that is the scenario in simple terms, the rest of your info is just embellishments that are not required at this stage

as you have already appealed and named the driver, there is nothing else you can do and its too late to appeal or to change your appeal, blabbing about the driver was foolish so accept that criticism and NEVER blab about the driver if you get any more private parking tickets

so if you have already contacted them , its too late to send in the black text appeal

    good luck and merry xmas

    Hi Coupon mad

the ticket was from UKCPS & it says at the bottom of the appeal rejection they are IPC & BPA, could you please advise which template I need to use to send them as I am finding it all rather confusing & don't wish to pick the incorrect one.

They are IPC AOS members but if you have already got an appeal rejection, TBH I would do no more and not send any template now, as you have appealed already. Sit tight.

Thanks Coupon-mad, should I not send them a further letter advising I am rejecting their appeal? to be honest this is scaring the pants off me, my husband has said we should just pay but but at the moment we simply cant afford to pay £100 if its not necessary.

I presume they will just continue to write to us?

Yes they will, big deal really. Letters are letters. Your husband is not correct, and there is no risk of bailiffs knocking on the door or a CCJ - which people think will happen from misunderstanding the TV prog 'Can't Pay We'll Take it Away' (High Court Enforcement is not relevant unless a person loses a case in court and the sum is over £600 AND they refuse to pay after losing the case).

    None of that will happen.

If you get a claim in 2018 come back, but UKCPS are not big players. No point responding again, and CERTAINLY make sure no-one pays it behind your back to 'help' (yawn) or phones UKCPS up. Nono!
