Letter from QDR for Premier Park ticket in 2015

  • I seem to be on the same path as jam1991's MyParkingCharge.co.uk thread.

    I emailed QDR my complaint and they've responded this morning with a template email requesting the same details (that they already have) plus whether I am the the only person accessing my email address. All of their correspondence to me is annoymous from "QDR Solicitors" (No Tim Hawker or Jane Clarke)

    I have responded in a similar manner, requesting full details of anyone with access to their email account, and stating that their stalling correspondence will be use as evidence in a claim for costs.

    I'll post if I receive a letter similar to Jam1991's responding to the emailed concerns.

    You don’t file a claim for “costs”. They’re just part of the normal part of a claim.

    I still seem to be following the same pattern as jam1991. I received almost a carbon copy of the letter posted by Jam1991 acknowledging and refuting my complaint. The main difference is that it is still from Jane Clarke, Customer Assurance Team, but this time For and on behalf of QDR Solicitors (previously For and on behalf of Wright Hassell Solicitors).

    A mildly interesting, but probably insignificant side note - in this latest letter, they have misspelled the surname of the recipient.

    I guess I just wait and see what happens next.

    Does anyone have any tips on how I can find out who manages/owns the car park/business park in question? I've tried researching it but only seem find estate agents advertising the empty units.

    I've read on other threads that it can pay to contact the owner of the land to instruct the operator to drop the fine - do you think it would be of use in this instance or are we now beyond that stage?

    1. Try phoning the estate agents to see if they can give you the info.

    2. Often on largish retail parks there’s a huge sign at the entrance with on-site the retailers listed. Many will have the name of the MA at the bottom of the sign.

    3. Contact you LA planning office, or rates department. Also try your local Valuation Office.

    4. Does the retail park have a Facebook or Twitter Page - ask on that.

    5. Then there’s the old stand-by (which doubtless you’ve tried) - good old Google.

    It’s never too late to get a landowner cancellation. Unless you try though, it’s never going to happen!

    It took a while but we managed to track down the property management company and get a response but it wasn't positive.

    The leasehold manager was incredibly sympathetic and helpful and requested that Premier rescind the ticket and send the admin fee to him for settlement.

    Premier's response:

    Subject: RE: ticket - ######

    Good Afternoon [Estate agent name],
    Please be advised that this PCN ###### is currently with solicitors and the total amount due is £###.##
    We will be unable to offer a reduced settlement due to the age & stage of this PCN.

    Is this true? I have read elsewhere that the leaseholder can ALWAYS cancel a PCN, do they need to be more assertive and demand it is cancelled?

    We’ve not had any further contact from QRD or anyone else and I’m yet to find any instances where QRD have resorted to court (both here and google searches). Has anyone else found anything?

    My next step will be to complain to my MP as inspired by another thread that pointed me toward this Parliamentlive.tv Parking Code of Practice Bill link

    AND THE SCAMMER REPLIED
    "We will be unable to offer a reduced settlement due to the age & stage of this PCN."

    ERR Dave old chap, you were not asked for a reduced
    settlement were you ...... WAKE UP

    And DAVE, old scammer, there is no stage of a scammers
    invoice that cannot be stopped with a flick of a finger

    So for being so unreasonable, it will be best to see what
    a judge says about this

    Ask that Managing Agent to confirm (in an email, that you can use as evidence at a hearing if needed) that he tried to cancel this charge, as is allowed in the contract with this parking operator, and not only does he not support it being pursued but without the MA's support, there can be no legitimate interest in recovering such a high charge.

    You want the words 'no legitimate interest' if you can get them!

  • Quick update...

    We've heard no more from QDR or Premier but a caseworker for our local MP Stephen Morgan has forwarded our case to Sir Greg Knight and written a detailed and strong letter to Steven Garrett (Director of Premier Park) questioning why he is pursuing us for payment given that we had authorisation to park there and that the managing agent have requested the ticket be cancelled.

    They acknowledged that it may not help, but that it couldn't do any harm. Either way I was impressed and grateful for the time and effort my MP went to!
