MBNA letter

Hi

Can someone please advise me - I recently put a PPI claim to MBNA which they accepted as being missold. However, they said they sent me a letter four years ago advising me that I was at risk and that they therefore only obliged to make a partial payment.

The problem is that I was not living at the address they sent the letter to at that time so therefore never actually received any notification.

This seems unfair and appears to give MBNA an opt out from their obligations to redress the miselling of the PPI.

Is there anything I can do about this?

Regards

Mark

    There is no opt out.

What do you mean by "at risk"?

Payments are normally only reduced if you failed to repay the debt in full or you made a claim on the policy.

If you can show you didn't receive the letter because you had moved you can ask the FOS to overturn the timebar, doesn't mean you'll have a succesful complaint though...but it's worth a shot because if you do, they will take off the money offered for the Plevin redress.
