Bath Waste Outflow Leaking for a Second Time

Options
Back at the beginning of September I had a leak underneath the bath that turned out to be the waste outflow so I had Dyno plumbing come and repair it, took a couple of hours as the bath panel had been tiled in by the previous owner so the plumber had to smash through it. Total cost was £220 and he replaced the bath waste and trap. All has been well since then.

This morning I had a knock on the door from the flat below and she had water pouring through her ceiling after I had a shower, at first I thought maybe the sealant had gone but after running the taps for a minute it was soon apparent that it was coming from a pipe, presumably the waste outflow again.

Typically it has passed the 90 day guarantee that Dyno offer by 13 days and just last weekend I paid £50 for someone to cut down and fit a new bath panel after having the tiled one smashed out last time.

Just wondering if I had any hope with getting something off Dyno or just go with a different company/plumber and should I remove the bath panel myself or just wait for the plumber to arrive to do it? It has obviously has sealant put around the edges so I'd have to cut all that out.

  • Just realised I paid on my Barclaycard, wonder if there would be any hope under 120 day purchase protection?

Anyone who performs a service has to use 'reasonable care and skill,' regardless of what they say about guarantees. Consumer legislation trumps that.

So, it might be argued in this case that Dyno didn't meet that requirement. They effected a repair, which it's reasonable to assume, should have lasted much longer than a few months.

In theory, you should offer Dyno the chance to put the matter right, FOC. If they refuse, you have the option of using someone else and recovering the repair cost via the Small Claims route. Then, if you win, it's 'just' a matter of getting them to pay up.

Many people would choose not to bother with the procedure above, which is why companies exist that do shoddy work.

However, we don't know that this work was shoddy, because until the bath panel comes off, no one knows for sure if the leak is at the joint that failed before, somewhere new, or even caused by the person installing the bath panel.

Legislation is one thing, and real world situations are another!

take the bath panel off and have a look,if its what was repaired recently then you can always complain to Dyno plumbing that the work was not up to scratch.

Try tightening the screw in the middle of the waste
ANURADHA KOIRALA ??? go on throw it in google.
  • Plumber came and confirmed the leak from the trap, some washers were missing.

He's written a short report for me on the receipt stating that whoever did the original fitting did not do it correctly.

Will send that off with the original receipt to Barclaycard to see if I can claim on purchase protection.
