Reclaiming Home Care costs in Scotland

A friend's father has just died in Scotland. He was eventually suffering from Alzheimer's, Parkinson and 3 types of cancer. 6 years ago as he went into care his wife died and he went through the pain of reliving the death on numerous occasions.
He had a pension and a house and while there appears to have been some accommodation upgrade for him what was once £100k has dissolved down to £10k.
The daughter who was looking after the money has had her own problems, suffering from a number of serious conditions and the council took control of his money for some of this period. While she does not think he should have paid she appears to have just paid. She is quite happy to try and get the money back if possible.
Where does my friend and her sister start? Who do they write to and what do they need to say?

  • Unless he had very substantial pension income £100,000 would have been used up well before the 6 years were up, so even if at some point he qualified for NHS funding i would not expect too much to be remaining, although once his savings dropped to £15,000 he should have been fully funded by the LA, so there may be grounds to claim at least some payment back.

    What makes her think he should have been fully funded for the whole period?

    Just that in Scotland there was some concept of the state paying if he was not safe on his own. He wasn't when he went in as he did not recognise his own children so could not be left on his own.

    That is social care not nursing care. AFAIK that would be self funded until his funds fell to a certain level.

    You will find information here about care home payments.

    Even if he was assessed as needing personal care he would still need to make some payment towards th fees.
