Default removal from credit file following court

Looking for a bit of advice. I had an ongoing issue with lending stream/asset collections in regards to a supposed loan. They said I owed it, I disagreed as I thought it had been paid. They didn't respond to any letters from me and the judge dealing with their county court claim has dismissed the case judging in my favour.

I have requested asset to remove all credit accounts from my credit report following the courts desicion but was wondering if they have to do this, and if they refuse do I have any recourse?

  • It depends on whether there was a valid reason for the default. The judge dismissing the case doesn't necessarily resolve that point.

    So it was a lending stream loan, bought out by asset collections and investigations ltd was it, and yes, i am familiar with them, as i`m dealing with them currently myself.

    Who registered the original default, lending stream or asset collections ?

    My point was that the loans were never taken out- I did have a loan with them and it was paid off. The court agreed with me as they did not prove the debt was owing.

    And the original default was from lending stream.

    In that case send a written complaint to lending stream, mark your letter "COMPLAINT".

    As they registered the original default, the responsibility to remove it also lies with them, explain the case to them, ask for the default to be removed as it appears it was incorrectly registered against your name.

    Give them the statutory 8 weeks to issue a final response, if your still not happy, take your complaint to the ICO.
