Car Insurance problem

Hi all
Just looking for ideas on the next thing to do.
Short story: item falls of van hits car and causes damage.
Van reported to police later and police supplied his details
Having supplied first his brokers details, then an old policy, the old insurers searched and provided current insurers details.

They are saying that until his broker has spoken to him to confirm events, they wont do anything.

Whilst this going on, front valance is getting weaker and supported by cable ties.

Any suggestions on how best to move forward.

I have just called and left polite message for him to contact me.

  • Claim on your own insurance, pay the excess and then get it back.

    Claim directly off the vans insurance.
  • Do you have the drivers details ?
    You can get quotes for damage, write to the driver stating you hold them negligent and send them the invoice for the repair.

    They can decide what to do over insurance.
    You can sue in county court if it is not paid.

    You have no contract with the drivers insurance.
    I do Contracts, all day every day.

    An item fell off a van... and the car then hit this item?

    Was the van driver negligent in loading the vehicle?
    Was the car following the van too closely, so unable to avoid what should have been avoidable?

    The van driver may well not be liable for the damage. Claim from your own policy, then let them deal with the other insurer.

    Totally agree with bit about car following too close, item falling off van will take longer to come to a stop than van anchoring on.

    Yes. Losing part or all of your load on the road is an absolute offence.
