Not for resale DVDs

I have a few films on DVD which are unopened in the original wrapping (they are from Sky, they were downloaded and watched on the Sky box so no need to play the DVD) and marked not for resale.

Can I sell them on Ebay as new or is that not allowed?

    Hmmm.... "Not for resale" - if only they'd made it just a tiny bit clearer. ;)

    There's nothing illegal about selling them. You would have to put on the listing that it says it on.

    There are quite a few things like that, multi packs of cans in supermarkets have "not to be sold separately" on them. It's merely so the manufacturer can discount them and continue to sell the single cans wholesale. Similarly Sky and the DVD companies don't want their DVDs on the open market undercutting the value of their other DVDs.

    The only risk is from Sky suing you, that would depend on the terms under which you made the initial purchase. That's extremely unlikely though as the adverse publicity would do them more harm than making an example of you.

    When I was in the auction business I sold quite a lot of items marked "not for resale", the main ones being manufacturer's sample packs. We often got those from the manufacturer so it was never really a problem.

    If you're ever unsure about the legalities of selling something check with your local Trading Standards, you can call them via your council.

  • Come on. It's a DVD that the OP would be lucky to get more than £3-4 for. I don't see Sky banging down any lawyers doors for that as one-offs. If they were selling hundreds of the same item they may take a different view. I sell plenty of items (CDs, DVDs & blu-rays) with not for resale on them. In terms of CDs, sometime they become collector's items. It's not a problem.
