Hi all,
Received a PCN for Unauthorised Entry / Parking. There for 49 minutes according to the entry the entry time and exit time although the difference between the entry time and the exit time is actually 50 minutes (not sure if this is relevant though.
Anyway we have submitted a Keeper's appeal to Premier Park and are awaiting a POPLA code.
Hoping we will be able to beat them at POPLA although technically the car shouldn't have been on-site at the accommodation.
There is a paragraph at the bottom of the PCN, it doesn't state anything about it being a Notice to Keeper, assume this comes later?
The paragraph says
"We now request this amount is paid using one of the payment methods described overleaf, If within 29 days we have not received full payment or driver details, under Schedule 4 of the Protection of Freedoms Act 2012, we have the right, subject to the requirements of the Act, to recover the parking charge amount that remains unpaid from the keeper of the vehicle"
I understand form other threads on Premier Park that this is an incorrect paragraph and we should be able to beat them at POPLA.
If anyone has any additional advice, I'd be grateful as I only have experience of winning against NCP so far!

if a pcn comes in the post , it is an NTK regardless of what it says on it
it comes in the POST as a Notice To the KEEPER, so is an NTK, or invoice
the one that is NOT an NTK is a windscreen ticket and is a Notice To the Driver
SO ANY POSTAL NOTICE IS AN NTK, even if it does not say so0 -
Throughout here you are advised never to reveal who was driving
You need to edit your post to remove details of who was driving
The ppcs monitor here and can use your posts against you0 -

1) irrelevant but in the keepers favour and not PP , although the BPA CoP interpretation would only help if it was say 10 minutes or less (grace period , clause #13)
2) irrelevant , it was on site , manned or unmanned , engine on or engine off , its on site without any authorisation , so is "parked" unless it drove round in circles for 49 minutes
we can never understand why people think that not having left the vehicle is somehow a valid reason ! its either occupied or unoccupied but this has no relevance to the fact that the vehicle is on the site
we hope this is won at popla but do not focus on the irrelevant , stick to the usual legal arguments that can sway a popla assessor
see post #3 of the NEWBIES FAQ sticky thread for the relevant arguments which wont include 1) or 2) above
and edit post #1 , it was THE DRIVER that was on site on the day and it was THE DRIVER that did not leave the vehicle
THE KEEPER is the person who received the postal notice and appealed0 -

No, that was the case a year or more ago.
This was discussed on here only last week, and on pepipoo forum where I posted over a dozen links to lost POPLA cases v PP, where not a single poster had been stupid enough to pay anyway, at any point.
Search the forum for the word 'Premier' on advanced search, and change to 'SHOW POSTS' on this board only. Not threads.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
