Plevin CCA Clause

I have requested PPI from Yorkshire Building Society under the Plevin Rule.
This has been rejected because I do not meet the rules?
Opened before 31/10/2004 and still open on 06/04/2008 - you have to meet both of these criteria which I find unfair.
I meet criteria one - mortgage taken out 1990 - but closed before 6/4/2008.

They have sent a reply stating "As it doesn't meet the criteria above the FCA do not require us to investigate this further and I can confirm no redress is due"

Has anyone else been rejected due to not meeting the above criteria.
I think this is unfair.

I am just about to complain to the FOC - will keep you posted.

    It doesnt really matter if you feel it is unfair. The consumer credit act has to be applicable.

    The FOS has no remit to change the law and no ability to time travel and change laws set in the past. It is there to apply FCA guidelines and it is the FCA that set these dates based on the history of the consumer credit act.

    So, what do you expect the FOS to do?
