HI, iv read the newbie thread but cant find what im looking for.
Last month we received a letter from gladstones solicitors saying that there was an outstanding fine and we needed to pay £160 or it was going to court, I asked them for proof of the alleged offence as weve never received anything, They sent one back and it from January 2016 when my car starting surging going through a petrol station, which was the only exit so i pulled over behind the forecourt, not blocking anyone or the pumps and called my husband whos a mechanic to either come and get me and our very young children or see if he could fix it.
I gave the petrol station mine and my husbands reg as there was parking signs up and havent heard anything until now with threats of court. Only mu husbands car got a ticket and not mine so i dont know whats happend. Ive emailed shell, who basically say tough, even though my car wouldnt drive right and i had a one year old and two year old with me. Gladstones say its too late to appeal and i now have 5 days after waiting to hear back from shell.
I feel sick as we dont have that kind of money so close to christmas, and we are applying for a mortgage next year so cant go to court.
Please can anyone help.

Going to court won't mean no mortgage!
So wait and see if you do get a court claim or lbcca and come back for advice on how to defend it0 -
If you haven't had a claim, you are not going to court. If you do have a claim then plenty of help here

its from E S parking enforcement, but ive only had letters from Gladstones solicitors.0

From what you say, depending on the PPC, it is most unlikely imo that a judge would uphold a claim. Indeed, were they daft enough to persist, they may end up paying you some money.
Did the LBC comply with the recent change in CPR?You never know how far you can go until you go too far.0 -
Im not sure, from the evidence theyve sent, my husbands car was there for a total of 9 minutes whilst he sorted everything out, the signage was all over though and we were both parked right under it, which is why i gave our reg numbers to the garage to avoid all this.
Im so confused to if a can appeal now or not, especially with shell being as unhelpful as they are.0 -
You are way to late to appeal. As I said earlier treat this as a LBC.0
