Hi all! what a great forum....

May get blasted for making a new post. Just trying to fight this in the correct way.

PCN ISSUE DATE: 13/10/2017
NTK (date of notice) 16/11/2017

The registered keeper received the NTK & was it was issued on 13/10/2017, registered keeper is now replying to these people....

The relevant signage is cracked in half and broken.... the person who issued the ticket has supplied photos.... but has taken photos of a different sign... one that the car was not directly parked under.... the keeper has OWN pics as proof. Does the registered keeper mention this in the first response? or stick to the template?

Edit*
Looking at the photos supplied..... his intention is blatantly obvious not to include this broken signage.

Parking Control Management (UK) LTD - IPC

Many thanks!!

Nearly there... Add the date of the NTD to your post and the date the NTK WAS received.

I'll let someone else take over now... I have a headache after all that...
    :)

Up to you really, nothing you say will get it cancelled and it's likely to roll on to a Gladstones claim in 2018, which if you stay here for advice & coaching, you are likely to win.

On balance if it were me, I would put in a strong appeal with photos of broken signs, and if this is the rk's own residential car park then also include a robust allegation that PCM are trespassing in your bay/breaching the terms of the resident's lease.

Or was it a shopping park? If so, complain strongly to the Store Managers and/or Retail Park, to cancel it.

  • Residential visitor parking, which requires a permit... there was an old one on display! but not valid. signage was broke & ticket issuer has used pictures of other signage...

when Gladstones get involved.... I believe there isnt much risk of CCJ or fines coming direct from me? so its worth playing out this process IMO.

I will appeal like you said...

Or take the stance of magna carta art 61... it would get rebutted before it went to court.
    (only just learnt about this!!)

Thank you so much for reply and help :)

Zero risk of a CCJ, if you don't ignore any court papers, directions or court decisions. Even the 1% of fully-caoched posters who report a rare loss at a hearing just pay, in the end, about £150 - £200 and there is no effect on credit rating.

    100% worth fighting in 2018.
