ANPR/CCTV false declaration?

Just a quick one for starters I recently received a PCN which stated
"The appellant was the keeper.
The operator is seeking keeper liability in accordance with PoFA..
ANPR/CCTV was used."
It is the statement ANPR/CCTV was used it clearly wasn't. Most likely a mobile phone or hand held camera. Is this a big issue making a false declaration or not? Thanks

Th DVLA seem quite relaxed (or not wishing to fall foul of the likely ire of the private parking industry) about hand-held cameras being the equivalent of ANPR.

As the PPC has mentioned CCTV, I think you’re entitled to receive copies of any relevant CCTV footage (for £10). If you want to try to paint them into a corner, ask them to confirm they have CCTV footage (as per their NtK) as you wish to have that provided to you - do some research as to which legislation covers this and quote it to them.

If they say they don’t have CCTV, then I’d go down the same route re ANPR. If no ANPR, then what exactly have they used? Then go into quality of the equipment used, etc, etc. None of these in isolation will likely cause them to cancel, but the cumulative effect might get them to see you’re an awkward !!!!, and they might give up. No guarantee this will work, but unless you try different methods of getting leeches off your back, they will continue to suck.

    Which PPC?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • It's parking solutions there is definitely no CCTV footage and no ANPN just a parking attendant with a hand held camera or phone. It was their declaration of "ANPR/CCTV WAS USED" which is clearly not true can I use this against them?
