Advice request for dealing with old debt and credit scores

  • I have to assume that as MBNA sold it to a debt collection agency in 2015 this would be six years after the original debt 2009 April it is now circling the debt agencies and has surfaced today
I can only see a reference on my clearscore account to this debt agency and not MBNA it just says negative, the name of the debt agency and next to it 'default or repossesion'

If it was defaulted back in 2009 and there's no CCJ, then my understanding is that it ought not be on there.

Worth getting the full report from Equifax if it's not on the account section of your Clearscore account? Be interesting to hear what the more knowledgeable posters say though.

First of all, make no contact and check if it's statute barred. That I suspect is the best thing to do first. Someone will be on here to give better advice soon I'm sure, but the only reason I suspect they're offering such a settlement is because they know it's unenforceable and they bought the debt for pennies.

But, have you checked your credit file, is it on there?

I have checked my clearscore account just now and it just refers to a negative with default or repossession and the name of the debt agency, there are no details or any reference to MBNA.

This particular agency look to be one that buys up credit card debts in tranches and as you rightly point out chase them all up until they get contact then go for collection anyway they can.

It’s at my doorstep now so I would like to understand how best to deal with it

You can sign up here and I think you can either get it as a one off or a free trial for a month. This is where Clearscore gets it's data and it give more information, so you'll see a lot more. Including the default date which I think is the crucial bit here.
  • Check what is on Noddle (CallCredit) and MSE Credit Club (Experian) before signing up with Equifax.

These will show the default dates if Clearscore is not
  • Have already signed up to equifax before reading this, it shows it as pra group credit card, PRA Group are the debt agency, it shows default balance at £596 and start date April 2009 then it goes on to state default date as being Feb 2015

I fear some of us may have misunderstood something from your first post. When you said "a MBNA debt of £596.19p dated April 2009" my assumption is that this is when the account was defaulted, in which case it would have been statute barred in many cases.

However, what the Credit report suggests is that the account was opened in 2009, but not actually defaulted until February 2015. Can you see the last payment you made on the credit report? I'm guessing maybe mid/late 2014? If that's the case, then the debt is still probably enforceable and it will stay on your credit report for 6 years after the February 2015 date.

However, that does seem to contradict why they would have volunteered a really low settlement. I'm at a bit of a loss. But if you can confirm when the last payment by you on the credit report for this card, it may help some of the others on here to advise.

That’s the problem, I have no idea what credit card it was, except to say it was an MBNA accredited one, the last activity on the account was around April 2009 for whatever reason which they will not discuss over the phone, MBNA sold 'the debt' which they defaulted in 2009 on what appears to be an open auction in financial circles, Activ picked it up and then released it then PRA Group bought a tranch of credit card 'debts' or defaults who then re packaged them as PRA credit cards and have put the default date forward to Feb 2015 ?

May I add that I am happy to settle this but am suspicious as to how it has been re packaged
