Hi I parked my hire car in the carpark at plymouth Lambhay on 7th October and yesterday i received a PCN for £85. I have writen to then with proof that we had paid £5-40 to cover the 3 hr parking period but the PCN was issued stating we were in the carpark for 3 hours 10 mins exactly i.e left exactly on the close of the 10 min grace period.
I'm fairly confident this PCN would be thrown out via a court as it details the time in the carpark not the time messing about with the ticket machine and then when it wouldn't accept payment my partner paid via her mobile phone however the car we were in was a rental and they didn't leave a PCN on the car but instead sent a request for driver detail to the hire car company who is demanding payment of £84 for forwarding on these details from myself.
I have sent an invoice to Britania Parking requesting they pay the adminsitration charge hence it wasn't the PCN for £85 but the admin cost taking the invoice to £169 ! even though we were withing the time limit.
When i signed the hire contract i wasn't clearly informed of this £84 charge which is high way robbery
Any thoughts, i have disputed the £84 and offered £30 but i will probably get a debt collection letter

Have you read the newbies thread? You pretty much started off incorrectly there, and for some reason offered to pay?!?0

You need to check the wording of the agreement you signed with the hire company to see whether it includes reference to ‘£85’.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi Thanks for the replies, not sure what i'm doing wrong as a newbie but it reply i got an email from my partner stating that the PCN had been cancelled however there is still the matter of the Admin charge of £84 that i have incurred because of the hire car co.
Yes it is apparently in the T&Cs of the contract but £84 seems a little excessive hence i offered them £30 but that is another issue.
I fully intend to hold Britania Parking responsible for the admin charge as they issued the PCN invoice without fully checking there was a breach of the parking T&C's
Any thoughts0 -
If the hire company are members of the BVRLA, they should have followed this Memorandum of Understanding between the BVRLA and the BPA. See if anything in it helps you.

You’re going to have to include your credit card company if the hire company has charged you against that. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Send the cancellation to the hire firm (of course) and ask for a refund of the ''admin fee'' and threaten them with the BVRLA ADR process if they don't...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Many thanks to the details about the BVRLA code of practice. I have emailed the compliance manager to ask if they are members.
I will update later but if Britania Parking do not refund me this admin fee i will file a money claim on line to get a judgement against them
Thanks

Britannia have no liability for an admin charge. You would have to file against the hire firm.0

Hi Guys, i did google and found green motion are in fact members of the BVRLA however when i read the 18 page code of practice i was unable to fathom out where the Hire Car co might be asked to waive the admin charge if a PCN is cancelled.
Myself i would have thought that Britania Parking should have checked if i really was liable before issuing a PCN and seeing as they have cancelled the PCN i clearly wasn't. Either way i still have the matter of £84. Why can i not hold the parking company liable for me incurring this charge
Thanks0 -

Because the hire firm probably have it in their t&cs that they will/should, I've seen this before. And £84 is extortionate.
They must be the ones you ask for a refund from. Do as advised. This is not the PPC's issue to repay, it's the Hire firm being unreasonable if they refuse to refund when you prove the PCN was cancelled (we do this all the time).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
