LL pulled out - return of deposit

    Was this a holding deposit or a security deposit?

    If security, was it paid more than 30 days ago?

  • Holding I believe, I paid on 13th Oct. It was to take the property off the market and then I'd pay my first month in advance when moving in.

    I have email confirming 'Thank you for you £400 deposit for ******'

    I paid by BACS and marked it as rental deposit.
  • When did you email the landlord requesting the return of the deposit?

    There is no requirement to place a holding deposit in protection. There is no 'compo'.

    Return will depend on the terms and conditions of the holding deposit and the reasons why the tenancy failed to commence.

    I requested return last night but sent a more formal email this morning.

    LL did not give any terms and conditions for the holding deposit, other than if I changed my mind she wouldn't be out of pocket.

    The tenancy failed to commence as LL received a malicious email from my previous LL and have now changed her mind. I offered new LL the opportunity to ask for references and proof of my rent payments (I am on time every time) but new LL hasn't taken this further.

    I don't think this is a scam the OP failed the checks.

    OP - You failed the checks I suspect the LL can keep the holding deposit. The reference isn't the new LL's issue.

    How did the new LL & old LL get eachother's contact details? You had to provide the link, presumably for a reference. If a reference was a condition of the letting which you failed, then you'd lose the holding deposit.

    Please clearly lay out what happened when and what was said surrounding the holding deposit. Unless you and the new LL still agree on the same terms or there's a written record, the expectation is you'd lose it if you fail a reference.
