    Of course not, but it would be his choice to trash his credit file and face any action that the lender may bring against him. The Child Maintenance Service can only force him to pay his assessed amount and no more.

    As I said in my first post, it's best if they can come to some agreement between themselves.

    Provided it isn't on Hire Purchase or otherwise excluded in his loan terms, he'd have proper title to sell without paying it off first.

    The OP isn't going to transfer the V5 though, so he'd have difficulty finding a buyer I'd have thought (unless he can get the DVLA to change it to his name on presentation of the bill of sale in his name.) I may be wrong but I can't see that happening.

    If the car was bought with a bank loan then the car is paid for so there is nobody to repossess it.

    If it is a bank loan he is not paying for the car. He is repaying a bank loan.

    However, the OP has not confirmed exactly where the finance for the car was from.
