This seems an eminently reasonable way of dealing with it.
In what way?
DVLA base the VED on the list price on the date of registration. Your car's list price on the date of registration was over £40k, so the VED hike applies.
You can ask the importer/manufacturer (who set the list price) to make a contribution. They may, of course, refuse. There's no more to it than that.
I have had numerous email during the order process from the dealer stating it would be in the lower tax band so I can’t see why I should pay the extra0 -

Maybe the dealer simply didn't know about the forthcoming list price rise?
You can ask them for a contribution towards the extra VED. If they say no, then what? You'll take them to court for it? Good luck.0 -

The dealer was foolish to give you written assurances about something entirely beyond his control. Some might say you were equally foolish to rely on them.0
