LBC from SCS Law - Meadowhall Staff

Hi there

Like many threads I have read tonight, I have recieved a scary letter from SCS Law contacting me on behalf of CP Plus Ltd stating I owe I large sum of money in parking fines.

From what I have read so far I've decided that, although this may be a fake letter sent by themselves as they ask for the money to be paid directly to them, I should respond. My problem is I have no idea where to start and what legalities to include in my response, any help would be greatly appreciated as my time to respond is limited.
From what I have gathered, ignoring this letter is a big no no?

Another thing I am worried about, is I am moving out in January. I'm afraid that if I ignore anymore letters or any responses I will emd up with court action I'm unaware of

Thank you in advance for any help

  • ok. So I may be wrong about this but...

I challenged a car park attendant at meadowhall on how they knew which people were leaving cars to use the trams and buses (the park and ride is always full). Apparently radio control watches people leaving their cars and watches to see if they go down the tunnel near Marks and Spencers exit.

Although I haven't had a ticket but the signs are all low down and unclear, I mainly wonder how they get away with misusing personal information like this. (any video capture is personal information). Essentially they are spying on you and then radio through to the car park attendant to slam a ticket on! A very unfair way of dealing with this.
  • If you are moving house you must have a post redirect in place whilst this matter is still ongoing. Otherwise you risk missing important documents.

If you have multiple PCN’s I advise that you seek professional unbiased legal advice from a solicitor.
If you were not the driver write to the parking firm and tell them who was so they CANNOT hold you liable. The person who was driving the car is responsible so let them deal with it. Not you! Don’t let people with an agenda tell you otherwise.
  • The signs say:

This car park is private land and is for the use of Meadowhall shopping centre customers only
No parking for on duty staff members, contractors or park and ride users.

Contractually this only allows parking for customers. If your not a customer then this sign is forbidding.

It would be worth finding out who operates the CCTV at the site. The parking signs say the CCTV is in operation for the purposes of crime prevention and detection.

This could well be a breach of the DPA if information is being passed to the PPC for detecting people leaving the site.

    RADIO CONTROL WATCHES PEOPLE ????

Do they think they are on the star ship SS Enterprise, you
know ... beam me up scottie ??

Predator tactics at the honey trap ? Is there a goon at the tunnel
    taking pictures ?

So be it one or multiple tickets they can all be handled as
individual tickets as each one will the same as the others
You could pay a solicitor a lot of money but REAL solicitors
will not touch the great parking scam, there are only
four who get involved and work for peanuts but they work
    for parking companies.

All the help you need is on this forum
  • This is interesting if they have CCTV evidence of drivers leaving their cars ... is this going to impact on the “not the driver” defence that some on this forum have suggested the shopping centre workers use?

The CCTV would have to track the driver all the way from the car park to their place of work if working there or all the way to leaving the boundary of the land occupied by the centre if they intend to issue a PCN for leaving site. All in crystal clear HD and they would still need to identify and put a name to the driver. Proper Jason Bourne secret service stuff.

Also the CCTV systems will be operated by the centre's security department, not CP Plus. If CP Plus tried to use CCTV footage in a court case, there would be serious questions as to how the they obtained it and the possibility of DPA breaches.

    Agreed.

Misuse and sharing of DVLA data won't go down well with a Judge.

    No. See above.

Of course Meadowhall victim staff SHOULD NOT be naming the driver. Please don't mislead newbies with wrong advice.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
