    Good, in that case if the cost was £100 or more you can make a Section 75 claim, or if it's less than £100 you can request a chargeback (you can do a chargeback even if it's over £100, and it may be quicker, although it's less certain than S75).
  • As per my post on 6th December, their Ts and Cs state 21 business days....

    My calculations place that at 15th December.

    So yea, I'll probably be proven wrong on Friday but you never know!!

  • Well not surprisingly, the refund didnt materialise by the 15th. In general correspondence Gala Hotels insist that the refund was "approved" on 8th December so they suggest that I contact my bank. Its now 20th December and still no refund. Perhaps they have strapped the cash to the back of a pigeon and sent it because it certainly isnt being refunded to my card.

    Have you tried contacting the bank? MAYBE they are telling the truth...?

    You could also maybe ask for a payment reference number from the company which will allow the bank to locate the refund.

    Do not use GALA Hotels -Booked as hotel cheaper than other online companies. Called hotel after a week and they had not received our names. Got a feeling something dodgy about them so cancelled. They have a 21business day refund policy which is too long, but its in their terms and conditions, they were late refunding by 2 weeks, even though I wrote and called. Their excuse was it was their bank which is so obviously a lie - nowadays a refund is as easy as a charge to make on electronic card machines. Only got a refund, the next day, when I pointed out they were breaking Turkish law. The amount was about GBP1100 so not insubstancial.

    please use this if it helps you get a refund.
    "You have, by not refunding my money in the 21 business days that you state in your conditions, breaking the law in Turkey as by your failure to refund the money in the time stated by you means you have amended the terms and conditions.

    "Terms and conditions of a consumer contract cannot be amended to the disadvantage of the consumer during its term."

    you have the legal obligation to complete the refund IMMEDIATELY as you are breaking Turkish Law.
    The Law on Consumer Protection numbered 4077 (the "Former Law") has been replaced by the new Law on Consumer Protection numbered 6502 (the "New Law") which was published in the Official Gazette on November 28, 2013 and entered into force on May 28, 2014."
