Moving in before they've moved out AFTER exchange

Vacant possession means just that, they vacate the property not become sitting tenants in the granny annexe.
Absolutely correct - but the original poster needs to be more clear whether or not they mean the vendors want to stay the night of exchange or the night of completion.
The contracts will state Vacant possession on completion, but the vendors usually do not have to have moved out before completion - they are withing their rights to still be living there when exchange of contracts takes place.

OK, weird situation.
Our sellers are fantastic people and as I am due to give birth very soon they are doing their best to help.
The property has a granny annexe at the bottom of the garden. They've asked if they can stay one night in there after we have exchanged. We're happy with that.
We're going to need accommodation for a wekk or so and as such it would solve many, many problems if WE stayed there for a week or so and paid them rent.
Could I have thoughts on this scenario please?
It would be after exchange but before completion and we would draw up a contract between us.
Many thanks
On the face of it, sounds OK.
However, given the potential legal complications, why not just rent a B&B/hotel for yourselves the week prior to exchange and they can rent a place somewhere the night after the exchange. If you want to show goodwill, offer to pay for their one night stay somewhere.
It just doesn't make any sense that they would want to move into the 'Granny Annexe' for a night, after they've sold you the house.
... Or defer exchange for one day.--
Every pound less borrowed (to buy a house) is more than two pounds less to repay and more than three pounds less to earn, over the course of a typical mortgage.0 -
Well, I never imagined my post would generate such strong feelings!
Anyway, thanks for the replies.
We've found another way round it."Finish each day And be done with it.

Some blunders and Absurdities have crept in.
Forget them as soon as you can."
