The law changed in April 07 is my deposit safe or not,my tenancy started on October 06

If you have had to re-new your contract after April 07 then it should have been switched to the protected policy automatically as I know ours was in May. I'm not too sure about the rules if you haven't re-newed your contract since sorry.I am a vegan woman. My OH is a lovely omni guy

If the fixed term tenancy expired after say six months and its now a periodic you would not have had to protect it. Basically if you haven't renewed the original tenancy you are ok but if you have renewed it after 7th April by issuing a new tenancy then is should have been protected.0 -

Whether it has been protected under the new laws or not is irrelevant really as to whether you get the deposit back. If you have moved out or are about to move have you had any contact with your landlord or letting agency about it? Your landlord could make deductions from your deposit for any damage to the property however, unless he has given you an inventory which you signed and has a signed check out report he wouldn't have a leg to stand on. I guess I am stabbing in the dark trying to help you as I'm still not sure why you are concerned about getting your deposit back?0 -
the LL said the carpets are grubby, i cleaned them he also said the oven was dirty, id cleaned that too, i havent had the check out report yet it was done last week i was not present LL has sold property stc new owner is gutting the place0

If I were you, I would contact the landlord politely but firmly by phone and ask him when you are going to be receiving your deposit back and how much he is intending to return. It sounds to me like he is considering making a deduction, in which case, you need to post back how much he is planning on taking and what for and you also need to confirm whether or not you have a signed inventory (i.e one that you signed when you moved in). The inventory will need to detail the condition of whatever it is he is trying to make a deduction for when you moved in otherwise a court would not uphold the deduction. It doesn't stop him making life difficult though although I would be jumping the gun by assuming this is what he is going to do. If you moved out last week then he hasn't unreasonably delayed returning your deposit yet.0 -
