Hi

I'm looking for any advice anyone can offer regards DWP claims against estates for potential over paid benefits - Pension Credits.

left by the government to fend for himself?

    what about his family?

if he was overpaid because of excess savings, then the overpayment will need to be returned.

considering he had over 16 k in savings at the time of passing, this shouldn't be an issue.

you may also find that housing benefit and council tax support may also have been overpaid because he went above the savings threshold

How much were his savings? When did they accrue?

If he went over 6k when he was on working age benefits (before he went on pension credit) there could be an overpayment there. When he went over 10k on pension credit there should have been a reduction in benefit. If he went over 16k entitlement to means tested benefits would end.

It doesn't matter that the savings came from benefits, or that he was virtuous and lived a frugal lifestyle, once the savings thresholds are reached entitlement is affected.

Have the DWP given an indication of what the overpayment is likely to be?

Sorry that this isn't the news you were hoping for.
Unless I say otherwise 'you' means the general you not you specifically.
