    Did you ever say why you thought it was wrong? I'm not saying you should have to, but if they were just looking at the new rates and not at your reduction in hours, that could easily happen.

    If you're in the union see if they will support you in not repaying the backpayments, but don't hold your breath. In which case jobbingmusician's advice is good.

    Advice is irrelevant esp on here of all places...you will be verbally stoned to with in an inch of your life for daring to suggest keeping the money,in fact i feel physically sick just thinking how you could possibly be right,despite asking three times to the very people who should know the answer...;)

    My irrelevant advice and i will be thrown stones at for saying this...is keep it and tell employer you asked the question,you was told it was yours and you spent it occordindinly,i mean if you was to have the mind set "I'm not sure if this months wages are correct"" how the hell would we all live and function.

    Maybe the people who didn't know what they were paying people should be retrained.:beer:
    If we ignore the appalling English, and the pot shots at people who do know what they are talking about, would you care to elaborate on the law that backs up your opinion, so that the OP knows upon what they are relying when they end up sacked and in court? I'm sure they'd find it tremendously helpful.
  • If you are in a union ask them to interject and ask that the new pay start from now...unlikely but you never know...


    A good few years ago now, when I was a naive young lad, we moved plants. At our induction to the new plant all the paperwork I had, had me down as a Team Leader, which I wasn't.

    I pointed this out at the time and paperwork was changed and though no more of it.

    A few months later some of us were talking about the forthcoming pay negotiations and it came to light I had been paid at Team Leader grade since moving.

    I saw my shop steward who said I would probably have to pay it back but would have a word with Personnel (before everything became HR).

    He argued my case saying I had been honest and had drawn the situation to their attention and they agreed to allow me to keep the money.

    It may be rare, but it can happen (admittedly this was a long time ago :D )

    When they responded, the hours they had for me were correct, and I explained to them the recent changes and I said in every email, that it seemed higher than I worked out, after tax etc. One staff member even showed a cut out of my own online pay slip to "prove" it was fine. In all honesty, the tone in that one was quite short. That's why in the last email I asked specifically about the salary before opting to stop bugging them.

    I did email them these comms but they said it's still an overpayment I'll have to pay back. So it looks like if anything I'd have to go to court to fight my case that I had every reason, and had been given reason, to believe it was right.

    Otherwise I'll have a double whammy, of a drop in pay I've had for this year, and then need to pay money back. Just doesn't seem fair, I mean, how many times can I honestly ask them to check?

    I don't think you will achieve anything by taking them to court. You have told them on numerous occasions that you believe they are overpaying you. Finally they have acknowledged that you are correct and have requested that the money be repaid.
    I can understand your frustration at how long it has taken them to get things right, but I think your best plan off action now is to offer repayment at a rate which will not impact unduly on your standard of living.
  • If you go to court you will fail since you have no claim, and if you carry on this path possibly no job in the ling term

    At the time it was an error and you accepted that it was right as they told you that fair enough, errors happen.

    But now knowing it was an error and you have been overpaid and accept that why would you try to keep it. Trying to keep it now is the equivalent of theft, you know it does not belong to you. If you tried to take legal action even if you did win I doubt very much your company would be impressed and would probably try to find a reason to get rid of you I know I would.

    Your best option is to work out a suitable repayment plan and look at it as having an interest free loan from your company for a year.
  • Can you ask HR/Payroll to arrange a repayment plan with a timescale that is acceptable and manageable to yourself? Maybe ask for the union and line management support in arranging this?
