PCN without entrance signage

I have received a NTK (ANPR system) through the post from ParkingEye for overstaying without payment in a car park that is free for 1.5 hours at ASDA and then becomes chargeable for up to 3 hours. Total time in the carpark is 2 hours 47 minutes.

The NTK contains the relevant "29 day" POFA 2012 wording.

The car park in question recently converted an exit road into an entry/exit dual lane road which ParkingEye have obviously added an ANPR camera to (since that's how we entered) but thus far failed to add any entrance signage although they highlight clear entrance signage on their PCN/NTK.

My question at this stage is should I highlight the lack of entrance signage in my initial appeal to ParkingEye or should I save that for the POPLA appeal and just aim at getting the POPLA number from ParkingEye?

    the blue text appeal does reference signage in the first paragraph

    the aim is not to blab about who was driving and to get a popla code

    BUT , a landowner complaint should be made first, to try for a landowner cancellation (ideally with proof of patronage)

    I would raise a complaint with leeds head office on the asda website and insist that they cancel it, with proof of patronage like receipts or bank statements

    if this doesnt happen by day 25 or so, then use the PE website and use the blue text appeal "as is" but adding redacted copies of the proof of patronage

    save your ammunition for the popla battle

    @Redx - Thanks. The blue text appeared to have the signage as a "token gesture" just to get to POPLA so I'll make the blue text complaint as-is and save the rest for POPLA if I need to.

    Should I create a new post for the POPLA draft (if required) or continue this one?

    I have complained to asda head office on their website myself , they control the parking throughout the country

    go to the top, dont faff around with the local store

    Just wanted to update that although I didn't seek help for my appeal here I did compile a POPLA appeal using the stickies for assistance.

    ParkingEye didn't contest the appeal so the parking charge has been cancelled.

    The appeal had basis in lack of entrance signage around a newly constructed entrance, lack of signage around the area just inside from that new entrance and a strict proof request for landowner authority.
