Resign or Get Sacked?

Hi

I really would appreciate any advice people can give.

I have been on long term sick for 6+ months and have failed to return to work on two occasions, both of which were phased approaches.

I attended a meeting today and was given two options:

1) Enter into a mutually agreed termination of employment on ill health grounds
2) Be put into the final phase of the sickness policy (and basically get fired instead)

Questions (apologies for so many)
--I want to leave the job, but which exit is most sensible?
--Does option one mean I've resigned and therefore can't get JSA, or should I not worry about that because I'll be able to claim ESA? (I'm not sure if I can)

Many thanks in advance, Nathan

You can resign on health grounds and make a ESA claim providing fit notes ESA. You must have worked 2 years before for contribution.
  • Sorry to read your story. Being sacked never looks great on a CV, albeit we can all see why it might happen.

Hope things work out better soon.
