    Have you actually spoken to the neighbour?

    Its first come first served on highway as you know but clearly there is more to it when it comes to neighbours you have have to rub along with afterwards. You both sound annoying to me, within your rights, but annoying nonetheless , sorry. It does look peevish to 'reclaim' the neighbour's 'established' spot especially when you don't take your car to work without so much as a friendly word. A note under the windscreen is likely to inflame as well.

    Parking across your drive might be a deliberate sabotage or it might not but its much easier to try and resolve face to face than in some kind of silent parking war. Fair enough, they may be aggressive and horrible but at least you'll know where you stand and can then decide whether to move your car for the quiet life or make more waves about them blocking your drive.

    Going straight to 'legal' rights with neighbours is rarely the best first option.

    Going straight to 'legal' rights is never a good idea when you don't have any. Maybe the neighbour knows legal rights better than you since he is parking across an empty drive

    If its blocking access across a dropped kerb then you can complain to the police / council (if decrim under TMA2004 I think only council can do this) and they then have removal powers. However thats pretty much the nuclear option.

    Also removal will only occur if there is a imminent danger to life or a series of warnings/PCNs have been issued. Otherwise just a PCN or a 'stern' letter

    My thoughts are that a council will ignore this because the dropped kerb, by the nature of the work being carried out, is no longer a dropped kerb for any of the conditions in S86.
  • As people have said...on public roads it's first come, first served.


    As regards 'dealing with neighbours parking etc'.....there are a variety of approaches...here's one


    Have an adult conversation with them, and either agree on a plan or agree to disagree


    If you agree to disagree there are then two options after that
    1. Let them walk all over you and do nothing about it
    2. Show them that you're prepared to stand up for yourself


    I was given advice by a police officer friend of mine....Never start something with a neighbour unless you are prepared to go all the way.

    1. “NO PARKING - KEEP DRIVEWAY CLEAR”
    2. “NO PARKING - PRIVATE DRIVEWAY - THIS DRIVEWAY IS ALWAYS IN CONSTANT USE, SO DO NOT OBSTRUCT”
    3. “PLEASE KEEP DRIVEWAY CLEAR - THANK YOU”
    4. “NO PARKING - 24 HOUR ACCESS REQUIRED AT ALL TIMES”
    5. “POLITE NOTICE - NO PARKING - PLEASE KEEP CLEAR”

    Drivers are not queuing up to park badly, and a polite notice speaks volumes.
