No fault car accident personal injury

Hi I was involved in a RTA last week and my daughter and I was hurt only minor Injuries. The accident was not my fault and the main driver has admitted fault but it turns out my policy had run out a week before so I wasn't insured. Am I and my daughter able to still have a claim against the driver even though i wasn't insured?

You should still be able to claim for injury, however car insurance usually auto renews unless the policy holder cancels it so not sure how you have been without car insurance for a week and not realised it was due.0

(OP, as above, your own insurance status doesn't affect your right to claim for damage or injuries caused by another driver's negligence.)0 -
Depending on the circumstances the only issue you may have is if the third party changes their version of events.0
