Who's in the wrong (overtaking - video inside)?

I've often wondered in this case. It's something you see happening regular, or at least i do around here & i've always wondered if there ends up a bump who would be deemed to be at fault.

It doesn't necessarily have to be this specific case but let's say inside car is A & overtaking car is B.

If B overtakes and clips A then B is wrong, right?

But if B overtakes and then A decides to not let B in by going from plodding along to accelerating hard to close the gap, is B still wrong? Can it wind up 50/50? A in the wrong?

Like in the video where they're driving along, it can come to a point where the person on the inside (A) is so determined to not let someone in that they are the ones who actually end up driving into / clipping the ones overtaking.

I know in the clip above it could've been avoided either 1) If the person hadn't overtook or 2) if the other person had just let them in, but then wouldn't life be so nice if everyone was so laid back all the time :)

    Idiots ......................plenty of evidence there to prosecute them both for careless/dangerous driving.

    Agree, both being !!!!!!!!s. I notice as well that despite driving in an aggressive and dangerous way when the opportunity arises to get out and have a go face to face both decide to not risk it!

    Yes, it's one of the things that makes motoring such a joy today.
    I reckon anyone driving like that needs their licence pulling.
    "Unsuitable disposition to operate a motor vehicle" (if only!)
    They're both a couple of pieces of door furniture.

    (a) He was filtering - the bikers say there's no law against filtering. Seeing as the law's the same for cars & bikes.....

    (b) the black one deserves to have his licence yanked, yhe blue one needs a lesson in knowing when to give up your right of way.

    (c) is that an Australian dashcam?

    Somebody once took great offence to me driving at the speed limit (indeed I may have slowed a little concerned at the dangerous way I was being followed :A)

    When we stopped at some lights half a mile later he jumped out of his car, so I got out, now I may be podgy but I am still 6ft1 and 15 stone. He must have suddenly remebered why he was in such a hurry in the first place as he jumped back in his car and took off through the red light!:rotfl:

    Re the two in the video the black car clearly is at fault but the blue car seemed to have forgotten how to drive defensively. Both idiots.

    but i guess i should've specified then - that i'm actually asking the question in the event that nobody behind has a dashcam/stops as a witness. So it's just you two & the cars in front say. It's going to be your word against theirs.


    A few years ago i was overtaking someone on a really long straight (straight is probably about a mile to a mile & half long) and the road is actually very wide. I've been told by those much older than I that it actually used to be a 3 lane road many moons ago but now it's just a really wide 2 lane road.
    Anyway i went to overtake this guy who was doing about 35 in a 50. He floored it & as i was overtaking him my passenger pointed out who he was. A local nutcase who's been in trouble with the law countless times, was turfing police out of his house as fast as they were entering & at a later date served some time for attempting to murder a pregnant woman.
    Anyway i made a decision to continue my overtake. Now it's all over it was obviously the wrong choice because this guy just swerved right in to me. He didn't just gradually turn in to me he swerved & hit me.
    I didn't want to stop as i now knew who he was so my plan was to get away from the guy, get home & report to the police. I got home but he'd already beaten me to it & then i was seen as the bad guy for not stopping. I said to the police - look i know you know who this guy is & that's why i didn't stop (& explained further).
    That's no excuse they said.
    Well when i think my safety is at risk i believe it is.

    The insurance said i was at fault for overtaking, simple.


    Now a few months ago i was actually in a sort of reverse of this only a few mile down the road. A pick up went to overtake the car behind me, me & the car in front all with oncoming traffic. He turned in to me.

    Now i know how MSE has numerous conspiracy theorists as members who will think it strange lightning has in a way struck twice but i can't do much about what twist these people want to put on it & i'll leave them to it.

    I pulled over to exchange details & he carried on. I took his plate, contacted the police. He was working on a job in the area but was actually based way down south.

    Story short - since there were no witnesses & the guy didn't stop, he just said he was never in an accident. He doesn't have to declare it on future insurance policies but i do. I said well since he's not punished & is saying he wasn't in an accident then no accident must've happened so i must surely be making it up therefore i don't have to declare it on any future policy. Nope that isn't the case - yes i do.
  • I'm surprised it was only a Peugeot and a Ford. Usually it's a BMW, AUDI, or a chavved up VW trying to push in without taking no for an answer.
